Orange County Superior Court - Invitation to Comment - Fall 2021

The Rules and Forms Committee of the Superior Court of California, County of Orange, has proposed revisions to the Local Rules of Court. Pursuant to California Rules of Court, rule 10.613, the Court invites you to comment on the following proposed changes to the local rules. If approved, the proposed changes will be effective January 1, 2022.

New Local Rule 393 – Labor Commissioner Appeals. The proposed new local rule would include language requiring e-filing parties to e-file copies of the bond or undertaking documentation along with the notice of appeal.

Revised Local Rule 611.06 – Capacity to Give Informed Consent for Medical Treatment. The proposed revisions to Local Rule 611.06 would include new requirements that Local Form L-3010, Attachment to Form GC-335, must be attached to Judicial Council form GC-335 when applicable.

Revised Local Rule 613.06 – Deposit of Funds of Guardianship Estate in Blocked Account. The proposed revisions to Local Rule 613.06 would allow the court flexibility to accept proof of continued deposits into the blocked account instead of requiring the filing of statutory required accounting schedules and to remove all references to Form 880.

Revised Local Rule 701(D) – Assignment of Family Law Cases. The proposed revisions to Local Rule 701(D) addresses the incorrect name of Local Form L-200 and lists the form as mandatory rather than optional.

New Local Rule 703.3 – Declaration of Supervised Visitation Providers. The proposed new local rule would serve as procedures for processing and maintaining declarations of supervised visitation providers.

New Local Rule 718 – Petition for Freedom from Parental Custody and Control. The proposed new local rule would help provide better access to justice for the public as well as provide support and directive on how to submit three mandatory local forms to the court.

All comments concerning a proposed rule must be submitted no later than 5:00 p.m. on Monday, October 4, 2021.
