OCBA Trusts & Estates Annual Seminar: The Efficacy and Defensibility of California Exemption Based Retirement Plans with a Bankruptcy Perspective

This program will address the efficacy of Exemption Planning as a subset of Asset Protection Planning for California residents, specifically the proper creation, use and defensibility of Retirement Exemption Planning using the California Private Retirement Trust (“PRT”) pursuant to California Code of Civil Procedure Section 704.115(b). This statute allows California resident business owners to recharacterize their otherwise exposed private assets to exempt retirement assets. Among the topics to be addressed include: the meaning of statutory exemption protection, the benefits thereunder, importance of properly creating and maintaining a PRT and corresponding private retirement plan, case precedent and history, weaknesses and exposures to creditor attack due to improper creation and/or administration from a litigator’s perspective, and a discussion of important considerations to be contemplated throughout.
