California Coastal Commission Case Law: The Effect of Moving Easements, Mean High Tide Lines, and the Public Trust Doctrine
This CLE overview presentation offers insights in the application of CCC guides and local government ordinances; and gives California real estate attorneys a focused legal update on recent Coastal Commission case law and an overview of regulatory trends impacting property rights in the coastal zone. Key topic trends include impact of interference of the water shed, floating public access easements, state sanctioned development, the legal effect of artificial Mean High Tide Line (MHTL), application and the scope of the Public Trust Doctrine in tideline disputes. Finally, the program will conclude providing real-world insight into post-fire and disaster rebuilds in the City of Malibu under emergency orders and strategies for navigating local agency procedures and securing entitlements.
