The Bookends of Employment Litigation: Identifying and Addressing Bias During Workplace Investigation and in Jury Selection at Trial
This presentation offers a deeper understanding of legal professionals' duty to recognize and counteract bias under California Rules of Professional Conduct Rule 8.4.1 and Business and Professions Code § 6070. Designed for employment law practitioners, the session provides practical strategies for identifying and addressing bias in impartial workplace investigations and jury selection.
The presentation explores the best practices for conducting unbiased investigations. By equipping legal professionals with actionable strategies, this presentation advances the elimination of bias in both the legal system and the workplace. In addition, the program will address challenges for cause to remove potential jurors for actual or implied bias and preview an upcoming change in the exercise of peremptory challenges that will significantly upend how practitioners approach jury selection. Specifically, Code Civ. Proc. Section 231.7 will allow an attorney to object to the opposing side’s exercise of a peremptory challenge based on unconscious bias.
