Enforceable Releases: Protecting Your Trustee Clients
This program will cover the enforceability of releases designed to protect the trustee from liability to the beneficiaries. Written releases in settlement agreements are generally enforceable without consideration between parties pursuant to Civil Code section 1541, which would include releases between two beneficiaries. However, when the party being released is the trustee, subdivision (b) of Probate Code section 16464 imposes four additional requirements on the trustee for the release to be effective. This program will discuss the four requirements and how best to satisfy them to protect the client/trustee.
This program is approved for 1.00 CLE Credit. This program Offers 1.0 California Legal Specialization Credit for Estate, Trusts & Probate Law Specialists. Attendees must have participated in the program in its entirety to receive MCLE credit.
