How to Avoid Unpleasant Collisions: The Intersection Between Real Estate and Bankruptcy Law
The presentation will focus on consumer and commercial issues that arise when a bankruptcy petition is filed as it relates to real property law and how to handle bankruptcy issues to protect your real estate client. Issues include: avoiding liens in Chapter 7 and Chapter 13 Bankruptcies; cramming down a consensual lien and interest rate change; default interest rates vs. penalties; strategies for Relief from Stays; bad faith bankruptcy filings; Exemptions; HOA liens dischargeability; how to ensure your sale is free and clear from bankruptcy liens and encumbrances; purchase options and whether they survive a bankruptcy filing.
