This MCLE presentation examines the grounds of inadmissibility for unlawful presence under INA §§212(a)(9)(B) and (C). The discussion focuses on how the June 24, 2022 USCIS memorandum reshaped adjudication of the 3- and 10-year bars under §212(a)(9)(B) while leaving the permanent bar under §212(a)(9)(C) untouched. Attendees will learn to distinguish between these statutory provisions, analyze lawful versus unlawful reentries, and apply current BIA and Ninth Circuit precedent in practice. The session will include practical strategies, case examples, and a step-by-step framework for assessing waiver eligibility and adjustment risks.
