Staying Ethical Under Fire: Navigating Immigration Practice Today
 
This program will explore anticipated developments in how immigration lawyers may be investigated or disciplined, particularly in light of the March 2025 presidential memorandum targeting legal advocates. We will review the authority of EOIR and DHS disciplinary offices and consider how that authority may be exercised in the current political environment. Topics will include the ethical risks surrounding allegations of “encouraging” and “harboring” under federal law, the revived focus on the Alien Registration Requirement, and the implications of attorney certifications and signatures on immigration filings—what it really means to “sign on the dotted line” in a high-stakes environment.
