2026 California Construction Law Update: Navigating New Retention Caps, Claims Mandates, and Evolving Defect Liability

This 60-minute presentation provides a critical analysis of new California construction laws in effect for 2026, including the implementation of the 5% retention cap on private works (SB 61) and new mandatory claims resolution processes (SB 440). The session will also cover significant 2024-2025 appellate decisions impacting construction litigation, focusing on contractor, design professional and owner/developer liability as well as the evolving scope of the Privette doctrine. Attendees will learn how these legislative and judicial shifts change risk allocation and project management for California practitioners.
