Is the Backdoor Closed? Sanchez, Hearsay & Expert Witness Testimony in Will & Trust Contests
The speakers will explore the application of People v. Sanchez (2016) 63 Cal.4th 665 to expert witness testimony generally, then specifically to will and trust contests. The application of the hearsay rule and its key exceptions will also be discussed, especially the Business Records Exception. Attendees will also gain a refreshed understanding of double hearsay and learn how to overcome, if possible, each layer of hearsay. A particular focus will be had on medical documentary evidence and the double hearsay often contained within it.
