Business Lit 101: What You Need to Know When Your Employment Case Involves Business Issues
Some cases don’t fit squarely into employment law. Often, business litigation is implicated. Is business insurance coverage triggered when an employee has a fiduciary role? What causes of action exist when an employee provides services under a third-party contract, including under the employee’s S-corporation? How should an employer respond if an employee has equity and wants to dissolve the company? When should an employer file cross-claims against an employee? What happens when an employee initiates a shareholder derivative suit? These and similar issues will be examined from both a plaintiff and defense perspective.
