Following the tragic death of George Floyd and the resulting movements demanding change, employment attorneys have faced various legal questions that are not only sensitive and difficult, but also reveal the overlap of various employment laws.  Panelists from both sides of the "v" will discuss the following during this candid presentation as it relates to the current social climate, including:
  • Employee social media posts and restrictions on employers relating to the review of employee and applicant social media
  • Employee and employer participation in protest movements, including employee protections and the effect of “ban the box” and other background check laws on employees and applicants engaging in protests
  • Employer statements in support of the Black Lives Matter movement, and legal issues surrounding individual employee responses
  • Employee rights under the NLRA relating to Black Lives Matter discussions in the workplace
  • Employee speech in the workplace, as relevant to both public and private employers
  • How employment lawyers on both sides can increase racial diversity within Orange County workplaces

This program is approved for 1.0 Elimination of Bias CLE Credit. Attendees must have participated in the program in its entirety to receive MCLE credit.
