Pitzer College v. Indian Harbor Insurance Company: Where Do We Go Now?
In August, the California Supreme Court unanimously held that the notice-prejudice rule is a "fundamental public policy" for choice-of-law purposes, and that it applies to consent provisions in first-party policies. This program will discuss:
- What the decision means for choice-of-law provisions in insurance policies.
- The implications of the decision for various types of first-party coverage.
- The effect on practitioners' choice of forum and decisions whether to remove to federal court.
