Because residential real estate values have increased, we are starting to see HELOC second foreclosures commenced by Mortgage Servicers. Borrowers are unaware that they are in danger of losing their homes because they believe that the Deeds of Trust securing HELOCs that were charged-off or discharged in a Bankruptcy years before are no longer enforceable. They are wrong. Julia Greenfield will discuss possible defenses and strategies for resolution as well as proactive measures that can be taken before foreclosures commence.
