A review of bankruptcy issues commonly impacting family law practice and strategies for addressing the issues. Topics for discussion include:
- Dischargeability of non-support marital debts: Chapter 7 versus Chapter 13
- Dischargeability of domestic support obligations and debts in the nature of support, including attorney fees
- The automatic stay: what is stayed and what is not, and how to get relief from the automatic stay
- Recent and pending cases affecting family law practice
