Adjacent Construction Claims - Technical and Legal Framework in California

In an urban environment, construction activities such as deep excavation and use of heavy vibrating equipment, if not carefully planned, could result in damage to adjacent structures and may eventually lead to lawsuits. The extent of damage could vary from a few surface cracks on the building exterior to settlement and even collapse. In this presentation, we will discuss the technical and legal frameworks in California for adjacent construction claims. We will also discuss the best practices before, during and after construction, and various ways structural engineers could assist to prevent and/or mitigate damage, including pre-construction surveys, access agreements, document review, monitoring plans, damage assessment and investigation, and insurance.
