A discussion of the right to a jury trial in a contested conservatorship setting, as well as practical considerations for deciding whether to request a jury trial and how to conduct one. The program will include a discussion of whether the right to a jury trial extends to other proceedings under the Probate Code with civil "cross-over" elements. Mr. Kemper will conclude by discussing the resolution of contested conservatorship proceedings and the effect of recent case law (Mesa RHF Partners LP v. City of Los Angeles, decided April 2019) on trial court interpretations of Code of Civil Procedure section 664.6.
